Terms of Service

Thanks for using Tjing.

Please read these Terms carefully. By using Tjing or signing up for an account, you’re agreeing to these Terms. We’ll start with the basics, including a few definitions that should help you understand this agreement. Tjing (“Tjing” or the “Service”) is a digital scoring service offered through the URL https://tjing.se (we’ll refer to it as the “Website”) that allows you to, among other things, create and manage certain events and tournaments, including, without limitation, scorecards and live scoring. Tjing is owned and operated by Tjing Group AB (“Tjing Group”, “we”, or “us”). You can be a customer to us either as private person or as an entity (“Member” or “you”). With “Club” we refer to any kind of sports association as well as a group of friends.

These Terms of Use (“Terms,” including our Privacy Policy) define the terms and conditions under which you’re allowed to use Tjing, and how we’ll treat your account while you’re a Member. If you have any questions about our Terms, feel free to contact us.

Terms of Service

You enter the Terms when you sign up for Tjing. Thereafter, the Terms applies as long as you use the Service. Clicking the button and entering your first and last name means that you’ve officially “signed” the Terms. The Service is only provided in accordance with these Terms, as well as in accordance with our Privacy Policy (https://tjing.se).

Registration and Accounts

To use the Service, you must register. You may however register for a specific event as a ”Guest” without creating a Tjing account. If you do so, you agree to comply with these Terms.

You agree to: (a) provide true, accurate, current and complete information about yourself (“Member Data”) and (b) maintain and promptly update the Member Data. You agree that Tjing Group may use your Member Data to provide Services for which you have expressed interest and as otherwise set forth in these Terms.

If you provide Member Data that is inaccurate or have created multiple personal accounts, Tjing Group has the right to suspend or terminate your account and refuse current or future use of the Services.

You’re responsible for keeping your password confidential. You’ll immediately notify us of any unauthorized use of your account. We’re not responsible for any losses due to stolen or hacked passwords. We don’t have access to your current password, and for security reasons, we can only reset your password.

The Service are intended for persons who are 13 years old or older. If you are under the legal age to form a binding contract in your jurisdiction, you must care for that your legal guardian has reviewed and agreed to these Terms.

Fees

In order to access certain functionality of the Services, you must pay subscription fees. Subscription fees, along with any required taxes, may be paid on a monthly or annual basis.

All subscription fees are payable in advance. Members changing from monthly to annual subscriptions will have the annual rates take effect at the beginning of the next billing date. You agree to pay the subscription fees, and other charges you incur in connection with your Tjing account, whether on a one-time or subscription basis. Tjing Group reserves the right to increase subscription fees, any associated taxes, or to institute new fees at any time upon reasonable advance notice.

Payments in general

You must designate and provide information about your preferred payment method (e.g., credit card, online payment service, a third party, like iTunes or Google Play, or any other payment method made available by Tjing Group (see TjingPay below). If you provide your payment information, you authorize us and third party service providers, payment card networks and payment processors to receive, store and encrypt your payment information. You may switch to a different payment method or update your information by visiting https://tjing.se/profile/billing at any time.

If Tjing Group is unable to collect any fees from an account designated by the user due to lack of funds, you bear all costs arising therefrom, including bank charges related to any debit entries or similar charges. Tjing Group may deliver invoices and payment reminders to you by email.

By using our Services, you agree to be subject to a possible service fee charged by Tjing Group for facilitating the provision of Tjing. Please note that, in case of refunds, Tjing Group does not reimburse the service fee in association to our service TjingPay unless otherwise agreed or stated in these Terms.

The use of TjingPay for Events or Clubs

TjingPay is the prescribed and sole approved payment solution when paying for events or Clubs carried out through Tjing. TjingPay is organized through the payment intermediary and third party Stripe. In the event of using another payment solution than TjingPay, in regards to events or Clubs, Tjing Group reserves the right to send you an invoice corresponding to 5 % of the paid value. In the case of recurring abuse by using payment solution other than TjingPay, Tjing Group reserves the right to suspend the Member’s access to the Service without prior notice. Tjing Group is not liable for any losses or damages incurred by the user as a result of such suspension.

Auto-Renewal

Subscription fees will be billed automatically at the start of the monthly or annual period, as applicable. These fees will auto-renew until your subscription is downgraded or terminated. Your subscription fee will be the same as your initial charges unless you are otherwise notified in advance. You may cancel your subscription at any time, as described below. Before auto-renewal of annual period, you will receive a reminder from regarding this and the possibility of signing off.

Cancellation of Subscription

If you signed up on https://tjing.se, you may cancel your subscription by visiting your “Profile Settings” page and selecting “Cancel subscription.” The cancellation of a subscription will go into effect at the end of your current billing cycle. When your subscription ends, your account will remain and become a free subscription. You can renew your subscription at any time without opening a new account, although the subscription fees may have increased. You can delete your account at any time. Tjing Group will not refund previously paid amounts.

Free Trials

Your subscription may start with a free trial. The free trial period for any subscription will last for the period of time specified when you signed up. Free trials may not be combined with certain other offers, as specified. If you begin your subscription with a free trial, we will begin billing your payment method for subscription fees at the end of the free trial period of your subscription unless you cancel your subscription prior to the end of the free trial period. Your payment method will be authorized for up to approximately one month of service as soon as you register for a free trial. In some instances, your available balance or credit limit may be reduced to reflect the authorization; however, no charges will be made against the payment method unless you do not cancel prior to the end of your free trial period. Please see the terms for auto-renewal, that will apply after your free trial period.

Termination

Once terminated, we permanently delete your account and all the data associated with it, including your account and activities. Results and place on leaderboards cannot be reinstated. You may request deletion of your personally identifiable information by contacting us at hello@tjing.se or via the Tjing mobile app. If you don’t log in to your account for 12 or more months, we may treat your account as “inactive” and permanently delete the account and all the data associated with it. After deletion results will then only remain in events etc. as anonymous.

Content

You represent and warrant that you either own or have permission to use all the information you make available in connection with the Services (“Content”). You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any Content that you post on or in connection with the Services. This license ends when you delete your Content or your account unless your Content has been shared with others, and they have not deleted it.

The Services may provide you with the ability to mark certain Content that you submit to the Services as private, public, or available only to selected users of the Services. Tjing Group will maintain the privacy of such Content in accordance with your elections. However, if you do not elect to mark your Content as private or available for a limited group, or later change such designation to allow such Content to be made available to anyone, you are responsible for the public nature of the content. Please review our Privacy Policy for more information on how to manage your privacy controls.

The Services may contain Member-generated or provided data, content, and materials (“Member Content”). As described in the Privacy Policy, Member Content may include, but is not limited to, your mapping of new courses, your ratings and reviews of courses, photos of courses, comments on blogs or other public forums, reviews of merchandise or other purchases, and reviews of the Services.

You are responsible for any Member Content you submit or make available through the Services. You agree that Tjing Group may use Member Content for any purpose, including, without limitation, to provide Services for which you have expressed interest and as otherwise set forth in these Terms.

If you violate any of these rules, then we may suspend or terminate your account.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Third Parties

Tjing Group or third parties may provide links to other internet sites or resources through the Services. Tjing Group does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You acknowledge and agree that Tjing Group is not responsible for the availability of such external sites or resources.

Clubs

Tjing Group creates and administers certain Clubs. We reserve the right to revoke or transfer ownership of Clubs, remove content, remove a Club’s verified status and remove a Club at any time. If you request a transfer of ownership of a Club, Tjing Group may require you to provide certain documentation.

If you create a Club on Tjing, you are responsible for ensuring that your Club: (a) abides by these Terms of Service; (b) does not claim, suggest an affiliation with, or impersonate Tjing whether by using Tjing Group’s intellectual property or otherwise; (c) has the right to use or post all Club content, third party or otherwise, including rights to use name(s), logo(s), images, trademarks, trade dress, service marks, copyrights, or other intellectual property; and (d) does not, in Tjing Group’s sole discretion, use the Club to inappropriately advertise or promote any contests, sweepstakes, or other promotions. Club administrators hereby agree to indemnify and hold Tjing Group harmless from any and all claims arising out of your Club, including but not limited to claims of intellectual property infringement.

As a creator of a Club on Tjing you function as the controller of the personal data of Club members. Please see our Privacy Policy regarding your obligations as creator of a Club.

Limitation of Liability

You assume full responsibility for any loss that results from your use. We won’t be liable for any indirect, punitive, special, or consequential damages under any circumstances, even if they’re based on negligence. If you are a consumer, we follow relevant legislation.

No warranties

We provide the material on the Website and the Service as is. That means we don’t provide warranties of any kind, either express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose.

You expressly agree that Tjing Group does not assume responsibility for the inspection, supervision, preparation, or conduct of any contest, challenge, event, or group activity that utilises the Services, including any that are organised by an administrator.

Proprietary Rights

You will respect our proprietary rights of the Website and the software used to provide Tjing. As a Member you therefore undertake to neither use or register Tjing Group’s trademarks or other proprietary rights such as patents, service marks, trade secrets, copyright, and similar.

You represent and warrant that you either own or have permission to use all the material and retain ownership of the materials that you upload to the Service. We may use or disclose your materials only as described in these Terms and our Privacy Policy.

Disclaimers

We aren’t responsible for the behavior of any advertisers, linked websites, or other Members.

Reporting Abuse

If you think anyone is violating any of these Terms, please notify us immediately.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Sweden without regard to its principles of conflict of laws.

The courts of Sweden shall have exclusive jurisdiction over any dispute, controversy or claim arising out of or in connection with these Terms, or the breach, termination or invalidity thereof. The District Court of Gothenburg (Sw. Göteborgs tingsrätt) shall be court of first instance.

Entire Agreement

These Terms and any additional terms you’ve agreed to by turning on specific features (“Additional Terms”) make up the entire agreement and supersede all prior agreements, representations, and understandings. Any Additional Terms will be considered incorporated into these Terms when you activate the feature.

Where there’s a conflict between these Terms and the Additional Terms, the Additional Terms will control.
